Welcome to Divizzy! These Terms and Conditions govern your use of the Divizzy mobile application and provide information about the Divizzy service. By using Divizzy, you agree to these terms. Please read them carefully.

Acceptance of Terms

By downloading, installing, or using the Divizzy app, you agree to be bound by these Terms and Conditions. If you do not agree to these Terms, you should not use the app. We may update these Terms from time to time, and your continued use of the app constitutes acceptance of any changes.

User Accounts

To use certain features of the app, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information when creating your account and to update your information to keep it accurate and current.

Acceptable Use

You agree to use the app only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the app in any way that violates any applicable law or regulation
• Use the app to send, knowingly receive, upload, or download any material that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Attempt to gain unauthorized access to any part of the app, other accounts, or computer systems connected to the app
• Interfere with or disrupt the operation of the app or servers
• Use the app to transmit viruses, malware, or other malicious code
• Collect or harvest any information from the app, including user information, without permission

Privacy

Your privacy is important to us. Our Privacy Policy, which is incorporated into these Terms, explains how we collect, use, and protect your information. By using the App, you consent to the data practices described in our Privacy Policy.

User Content

You retain ownership of any content you post, share, or submit to the app ("User Content"). By posting or sharing User Content, you grant Divizzy a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in connection with the service and our business (including for promotion or redistribution in any media formats and channels). You represent and warrant that you have all necessary rights to grant this license.

You are responsible for User Content you post or share. User Content must not be illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable. We have the right to remove any User Content that violates these Terms or is otherwise objectionable, without notice.

If you believe that your work has been copied in a way that constitutes copyright infringement, please notify our Designated Agent at:

Please include the following in your notice:

• A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
• Identification of the copyrighted work claimed to have been infringed
• Identification of the material claimed to be infringing and where it is located on the app
• Your address, telephone number, and email address
• A statement that you believe in good faith that the use of the material is not authorized by the copyright owner, its agent, or the law
• A statement that the information in your notice is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on their behalf

Subscriptions & In-App Purchases

All purchases within the Divizzy app are processed by Google Play Billing. By making any purchase, you agree to the following:

• All purchases are final unless refunded per Google Play's refund policy
• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage subscriptions and turn off auto-renewal from your Google Play account settings
• Refunds for purchases are governed by Google Play's refund policy
• Free trials, if offered, will automatically convert to paid subscriptions unless cancelled before the trial ends

Termination

We may suspend or terminate your access to the app immediately, without prior notice, for conduct that we believe violates these Terms or is otherwise harmful to the service or other users, including:

• Breach of any term contained in these Terms
• Unauthorized use of the app
• Attempting to gain unauthorized access to any portion of the app
• Harassment or harm to other users
• Use of the app for illegal or fraudulent purposes

Upon termination, your right to use the app ceases immediately. We may also delete your account and all associated data in accordance with our Privacy Policy.

Age Rating

This app is intended for users aged 13 and older. If you are under 13 years of age, you must not use the app. We do not knowingly collect personally identifiable information from children under 13. If you are a parent or guardian and you are aware that your child has provided us with personal data, please contact us at contact@duncled.com.

Limitation of Liability

To the maximum extent permitted by law, Divizzy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the app.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Divizzy operates, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms shall be resolved through binding arbitration under JAMS rules, with the arbitrator's decision being final and binding. YOU AND DIVIZZY AGREE TO RESOLVE DISPUTES ON AN INDIVIDUAL BASIS AND NOT AS A CLASS ACTION.

Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes to these Terms, we will notify you by email or by posting a notice in the app. Your continued use of the app after such modifications will constitute your acknowledgment of the modified Terms and agreement to abide by them.
